NOTICE OF PRIVACY PRACTICES

This Notice explains how we may use and share your health information and how you can see or get a copy of it. Please read it carefully. 

Our Promise to Protect Your Privacy 

Shared Wellness is required by law to protect the privacy and security of your health information. This includes extra protections for information related to substance use disorder (SUD) treatment. 

We must follow the privacy practices described in this Notice. We will give you a copy of this Notice. We will also let you know if there is a breach that may have affected the privacy or security of your information. 

How We May Use and Share Your Health Information 

Treatment, Payment, and Health Care Operations 

We may use and share your health information to: 

• Provide you with care 
• Coordinate your care with other providers 
• Get paid for services 
• Run our programs and improve the quality of care 

These activities are called treatment, payment, and health care operations. 

If you receive substance use disorder services, you may sign one written consent that allows us to use and share your SUD records for treatment, payment, and health care operations in the future. You may cancel this consent at any time by telling us in writing. 

Sharing Your SUD Information After Disclosure 

If you allow us to share your SUD records for treatment, payment, or health care operations, the person or organization that receives them may be allowed to share them again under HIPAA rules. In some cases, the information may no longer be protected by the stricter federal SUD privacy laws, but it may still be protected by other privacy laws. 

Fundraising Communications 

We may contact you to support our programs. If we plan to use your SUD information to contact you for fundraising, we will first give you a clear way to say no. You can opt out of fundraising messages at any time. Saying no will not affect your care or services. 

Other Ways We May Use or Share Information 

We may also use or share your information when the law allows or requires it, such as for public health, safety, audits, licensing, or to prevent serious harm. Any other use or sharing not explained here will only happen with your written permission. 

Extra Protection for Substance Use Disorder Records 

Federal law gives extra privacy protection to substance use disorder records. 

Use in Legal Proceedings 

Your SUD records, or information about them, cannot be used against you in civil, criminal, administrative, or legislative cases brought by government agencies unless: 

• You give specific written permission, or 
• A court issues a legal order that meets federal requirements 

SUD Counseling Notes 

Notes written by your SUD counselor that are kept separate from your medical record have extra protection. We usually need your separate written permission to use or share these notes. 

Your Rights 

You have the right to: 

• See or get a copy of your health records 
• Ask us to correct information you believe is wrong or incomplete 
• Ask us to contact you in a certain way or at a certain place 
• Ask us to limit how we use or share your information (we may not be able to agree to all requests) 
• Get a list of certain times we shared your information, including for treatment, payment, and health care operations if your records are electronic 
• Say no to fundraising messages at any time 
• Get a paper copy of this Notice, even if you received it electronically 

 

Our Responsibilities 

We must: 

• Protect the privacy and security of your health information 
• Let you know if there is a breach of unsecured health information, including SUD records 
• Follow the terms of this Notice that are currently in effect 

Changes to This Notice 

We may change this Notice. If we do, the new Notice will apply to all health information we have about you. The updated Notice will be available upon request and on our website, if we have one.
